Class Actions


Class actions in Canada continue to grow in prominence and complexity.  Class actions are common in disputes involving securities, price fixing, product liability, consumer protection, privacy breaches, environmental disasters, humanitarian issues and others.  For class damages, it is imperative to identify and secure access to relevant financial information.  A measured assessment by experienced financial experts is necessary at the pre-certification stage, as well as post-certification.  

CHS has significant experience as financial experts in major class action assignments, for both plaintiffs and defendants, involving the Class Proceedings Act, the Consumer Protection Act and the Competition Act.  These mandates have included the assessment of individual versus aggregate damages considerations as well as the quantification of Canada-wide class damages involving: unpaid overtime, misleading representations about consumer products, undisclosed administrative and financial charges, low/high donation schemes, failed investment funds, and others.
