Restaurant Chain Shareholder Dispute

Shareholder dispute involving the value of a group of regional restaurants and bars, a particular Shareholder’s interests therein, and the Arbitration of the value thereof.

This action initially involved a number of claims by a minority shareholder, including oppression by the majority shareholders.  Remedies requested included preparation of audited financial statement for each entity, a buyout of the minority shareholder’s interests, or as an alternative, a winding up of the group. The parties eventually agreed to conduct an arbitration in respect of the value of the interests of the minority shareholder.

We were retained as the Arbitrator in this matter, based largely on our knowledge, experience and reputation. Our engagement involved the structuring and conducting of the Arbitration, as well as dealing with a number of issues that arose prior to the Arbitration hearing.
