Damages assessment involving defunct electronics/lighting re-seller against Hydro One Networks, alleging negligence or negligent misrepresentation and breach of contract.

This action involved a claim by a failed entity, Reset Electronics Inc., against Hydro One Networks Inc. relating to Hydro One’s handling of rebate programs related to the sale and installation of efficient lighting.

CHS was retained by Counsel for Hydro One as financial experts to quantify the losses allegedly suffered by Reset and to comment on the Plaintiff’s expert report.  CHS also assessed the financial information and viability of the Plaintiff and considered whether there was alternative causes for its failure.

The trial judge determined that Reset did not have any claim for losses. However, the trial judge noted that, had she found Hydro One responsible for Reset’s losses, she would have limited the damages award to the lost profits calculated in the CHS report.
